Barnard Kilpatrick was a 20-year-old from broken Hill in New South Wales. He. Applied for full exemption from military service because he believed the Vietnam war was illegal and immoral. His hearing was at the Broken Hill Court of Petty sessions om 25 January 1968. His application was heard by Magistrate CR Briese who stated the Barnard’s views were sincere and conscientiously held. However, as the applicant had stated he would be prepared to serve in the military forces in certain circumstances he had not brought himself within section 29A of the National Service Act as he had to object conscientiously to all wars not a particular war. The magistrate said that because Barnard’s view was sincere he granted him exemption from combatant military duties. It is unknown if he appealed.
