Further Information:
Robert Garrick of Malabar Heights in New South Wales was 23 years old and a Structural Draftsman. He applied for full exemption from military duties as a conscientious objector. The Sydney magistrate’s court hearing was held on 23 January 1970 and heard by Magistrate Burman. Robert was unrepresented at the hearing. The magistrate granted him exemption from combatant military duties only. A comprehensive summary of the magistrates reasoning for his decision is available and form part of an extended entry for Garrick. The magistrate despite him being satisfied that Robert was a non-aggressive person and did not believe in violence exempted him from combatant military duties only. He further stated that he believed Robert was not a 100% pacifist. Robert appealed the decision, and the appeal was heard on 17 April 1970 at the District Court in Sydney. It was heard before Judge Henchman. The judge upheld his appeal and granted him full exemption from military duties as a conscientious objector.
